Facts: The Plaintiff claimed that she worked as a cashier for defendant for one and one-half years without any disciplinary issues before becoming pregnant. When she learned that she was pregnant, she requested that her pregnancy be accomodated by granting her a transfer to a
location that did not expose her to conditons that caused her health difficulties. The Plaintiff claimed that her request was ignoredShe was then transferred to several locations where she was forced to endure conditions that she claimed exacerbated health problems that the plaintiff suffered incidental to her pregnancy. The plaintiff was terminated for an alleged act of dishonesty.
Plaintiff's Contentions: Plaintiff contended that the defendant harassed her because she became pregnant and needed accomodations; that the excuse for her termination was a pretext for discrimination.
Defendant's Contentions: The defendant contended that the plaintiff's pregnancy was accomodated and that Plaintiff was transferred to a safe working environment upon notification to defendant that she was pregnant. The defendant further contended that plaintiff was caught by an independant auditing firm committing an act of dishonesty which, pursuant to company policy, mandated that she be terminated.
